These Terms apply to purchases of products made by consumers from FIOFIO through the website. By placing an order, the customer acknowledges having read and accepted these Terms, subject to the rights granted by applicable law, including Québec's Consumer Protection Act. In the event of a conflict between these Terms and a mandatory provision of the law, the applicable legal provision prevails.

FIOFIO strives to accurately present its products, including their:

• features
• dimensions
• colours
• materials
• quantities
• images
• availability

Colours may nonetheless vary slightly depending on the customer's screen. Products are available while supplies last.

Prices shown are in Canadian dollars (CAD), unless otherwise indicated.

Prices shown do not include applicable taxes (GST/QST) or shipping fees. Before the order is placed, FIOFIO shows the customer the applicable price, shipping fees, applicable taxes, and total amount due.

FIOFIO may change its prices or products at any time. However, the price applicable to an order is the one shown to the customer at the time the order is placed — with no effect on orders already confirmed.

The customer must review their order information before confirming it, including:

• the selected products
• quantities
• variants and colours
• shipping address
• applicable fees
• shipping method
• total amount

The cart allows the customer to adjust quantities or remove an item before confirming their order. An order is deemed placed once the customer confirms their purchase through the process provided on the site — an order number is then assigned, and FIOFIO sends an order confirmation to the email address provided at checkout.

After the order is placed, FIOFIO sends the customer, by email, a confirmation including notably: the order date, a description of the items purchased, the price, fees, taxes, payment method, shipping address, and a link to the applicable return conditions.

Online payment is securely processed by Stripe, our payment services provider.

Deposit payment

For an order of $100 or more, the customer may choose to pay in full, or to place a 20% deposit at checkout and pay the balance within the following 7 days. This option does not restrict the cancellation or refund rights granted to the consumer by law.

Shipping terms and fees are shown to the customer before the order is confirmed. The customer is responsible for providing an accurate and complete shipping address. Delays related to the carrier, customs, or circumstances beyond FIOFIO's reasonable control may affect delivery, without limiting the consumer's rights under the law. Online purchases are subject to the rules applicable to remote contracts in Québec. Under certain circumstances provided by the Consumer Protection Act, a consumer may cancel an order. Cancellation conditions and applicable timelines are detailed in our return policy.

Returns, exchanges, and refunds are subject to our return policy, to the extent it complies with the rights provided by law. This commercial policy does not remove or limit the mandatory warranties and protections provided by the Consumer Protection Act.

Products sold by FIOFIO benefit from the legal warranties applicable in Québec. These warranties apply automatically and at no cost — they notably include the warranty of fitness for use, the warranty of reasonable durability, and the warranty against latent defects. When a product has a problem covered by a legal warranty, the consumer may exercise the remedies provided by law. Nothing in these Terms is intended to exclude or limit these warranties.

FIOFIO makes reasonable efforts to keep availability information up to date. Once an order is placed, FIOFIO fulfills its obligations relating to that order.

FIOFIO strives to maintain accurate information about its products and prices. If displayed information contains an error, FIOFIO will take appropriate steps in accordance with applicable law. FIOFIO does not reserve a general right to cancel an already-placed contract solely because a price or description error was discovered after the order was confirmed.

FIOFIO takes reasonable measures to ensure the availability and security of its site. However, FIOFIO cannot guarantee that the site will be accessible without interruption or free of technical errors. Nothing in these Terms limits the rights and remedies available to the consumer under applicable law.

Content on FIOFIO.ca, including text, photographs, images, logos, and graphic elements, is protected by applicable law. It may not be reproduced, copied, distributed, or used for commercial purposes without the appropriate authorization of FIOFIO or the relevant rights holder.

Personal information collected when placing an order is processed in accordance with our Privacy Policy.

FIOFIO may communicate with the customer regarding:

• their order
• their payment
• their shipment
• a return or refund
• an issue with their order
• any other matter necessary to fulfill the contract

Commercial communications are carried out in accordance with applicable law.

FIOFIO may update these Terms to reflect changes in its services or legal requirements. The version applicable to an order is the one in effect at the time the contract is concluded. The last update date is shown at the top of this page.

These Terms are governed by the laws of the province of Québec and the applicable federal laws of Canada. Nothing in these Terms deprives a consumer of a right or remedy granted by applicable law.
